My Union Is Not Upholding The Contract Agreement We Have In Place For Medical Benefits. What Can I Do?

On Behalf of | Jun 24, 2015 | Employment Law

If you are part of a union as far as your job is concerned, it is their responsibility to hold up on their end for any agreements or compensations that they provide to their employees. This is one of the major benefits of having a job that is part of a union, and when you find out that they are not upholding their contract agreements, you may feel at a loss as to where you can turn for help. Keep in mind that a binding contract for medical benefits within your company is the responsibility of your union and that the contract states that they are responsible. When they breach this contract, you can and should get compensated.

One of the first things to look out for would be the union beating around the bush about their contract breach. They may offer other things to compensate for medical benefits or they might avoid answering your questions altogether. If this is the case, it might be time to think about taking the union to court to receive compensation. This is something that can help you to receive those medical benefits without having to figure out how to do it all on your own.

Another thing to keep in mind is that your job’s union will probably have their own lawyers, so it is vital that you also get your own attorney who can help you to win your case. There is going to need to be a lot of evidence when filing this type of claim in a court of law, so make sure to sit down with your attorney and discuss the case from beginning to end so that they can suggest what types of evidence you might need to better off your claim.

Just because you were denied medical benefits when you know you are entitled to them doesn’t mean that this is the end of the story. You can and should fight for your medical benefits so that life is easier for you in the long run. If your union has medical benefits in its contract with employees, this is definitely something to bring up if you are taking them to court because of the breach in their contract. A good attorney will be able to sit down with you and discuss the nature of the case, what types of paperwork you will need and the possible outcome.
