Filing workers’ compensation claims

Oklahoma workers who have been injured on the job need to be aware of their rights and responsibilities when it comes to filing workers’ compensation claims. While the right to compensation for work-related injuries is an important benefit, it is up to the employee to ensure that claims are appropriately filed within the state’s two-year statute of limitations.

While many employers take appropriate precautions to ensure the safety of their workers, some are not always so diligent. In addition, accidents happen and there are certain activities that carry with them a real risk of causing injury. When an employee sustains an injury, it cold have significant future effects. This may include the inability to continue in one’s job, as a serious accident may result in the worker becoming totally disabled and unable to maintain employment.

The workers’ compensation program provides financial benefits to workers who become injured. It is up to the worker, however, to file the claim for benefits. Sometimes workers aren’t always aware that aches, pains and other physical symptoms indicate a serious medical condition caused by workplace injuries. As a result, they may not file for benefits in a timely manner. This could cause the worker to lose out financial assistance that may be desperately needed.

In addition to consulting with a physician for appropriate medical diagnosis and treatment, some injured workers may benefit from obtaining the advice and counsel who has experience with these matters. The attorney can often assist in the preparation and filing of the claim, and might also provide representation at a future appeals hearing should the claim be disputed or denied.
