When the injury is real but the claim is questioned

Getting hurt at work can turn your life upside down. When you are in pain, unable to work and trying to heal, the last thing you expect is for someone to question whether you are telling the truth. But for many injured employees, that is exactly what happens. Even with a real injury, some workers find their claim is viewed with suspicion by employers or insurance companies.

This often happens when an injury does not heal as quickly as expected or when symptoms seem more severe than the insurer thinks they should be. Some workers face pushback if they need extended time off, especially if a doctor clears them to return but they still feel unwell. Others may be accused of exaggerating if they add new symptoms after the initial report.

Why your workers’ compensation claim might be under scrutiny

It is common for injured workers to feel pressured, watched or even blamed. You may hear things like, “You do not look hurt,” or be questioned for everyday activities that do not reflect how you feel inside.

Insurers usually look for signs of so-called “inflated claims,” such as:

  • Discrepancies in medical records: If documentation does not match your experience, it can raise questions, even if you are being honest.
  • Delays in returning to work: Some employers may pressure you to return before you are ready. Or they may use your hesitation against you.
  • Surveillance or supervisor reports: Everyday activities like picking up a child or walking without assistance might be misinterpreted as proof you are “not really injured.”
  • Ongoing symptoms or added injuries: If your condition evolves or new pain arises, it can be seen as suspicious, even though it is a normal part of recovery.

Your injury is real, and you deserve to be treated with respect. If your claim is being questioned, working with someone who understands your situation is vital. A dedicated legal team can help you handle the process and stand up for the compensation you need to move forward.
