Forced to Work through Lunch with NO Compensation

My Boss Forces Me To Work Through Lunch Without Compensation

Your stomach voraciously growls as you end your shift. Working though lunch, as you had all week left you more than ready for dinner. With all the added pressure of a deadline your boss has had the entire crew working through lunch. It's annoying, but you comfort yourself with the fact that you will be getting paid extra on this check and can take you and a date out for a big, fancy dinner. You are handed your check and open it once inside your vehicle. You can't believe what you're reading, the extra lunch hours that you worked through are not recorded! It seems you won't be getting that nice dinner after all. What can you do?

What To Do When You Are NOT Paid Wages For Hours Worked

Even though Oklahoma is not required to offer a lunch break for employees' ages 16 and older, they are required to pay for hours that are worked. Also, if the company does offer the benefit of a lunch break, and it is in your employee handbook or contract, than you may be entitled to compensation even if you were paid for the hours worked.

  1. Wait. You employer must set regular pay dates within (11) days of the end of the pay period and have an additional 3 days after regularly scheduled pay date to issue payment.
  2. Contact a labor compliance officer at the Oklahoma Department of Labors wage and hour unit in our Oklahoma City office405-521-6100, or 888-269-5353, or at the Tulsa office, 918-581-2400.
  3. Download a wage claim form from www.labor.ok.gov.
